These Terms & Conditions (“Terms”) govern your access to and use of the KT AI website, products, platforms, APIs, and services (collectively, the “Services”).

KT AI is a trade name used for promotional and product purposes and is operated by Kunisha Traders, Jaipur, Rajasthan, India (“we”, “our”, or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use KT AI services. By using the Services, you represent that you meet these requirements.

Scope of Services

KT AI provides a WhatsApp Business Service Provider (BSP) platform, shared inbox, automation tools, APIs, analytics, and conversational AI capabilities that enable businesses to manage customer communications.

KT AI acts solely as a technology platform. We do not initiate WhatsApp messages on our own behalf and do not control the content sent by customers using the Services.

We may modify, suspend, or discontinue any part of the Services at any time without prior notice.

User Responsibilities

• You agree to provide true, accurate, and complete information during registration and use of the Services.
• You are responsible for all activity conducted through your account and workspace.
• You must ensure compliance with WhatsApp, Meta, and all applicable local laws when using the platform.
• You must not use the Services for unlawful, deceptive, abusive, unsolicited, or unauthorized messaging.
• You are solely responsible for message content, templates, workflows, automation rules, and data processed through KT AI.

WhatsApp Business Platform Compliance

Use of KT AI for WhatsApp messaging is subject to Meta’s WhatsApp Business Platform policies. KT AI acts solely as a technical and service provider facilitating access to the WhatsApp Cloud API.

All messaging activity must be initiated or explicitly approved by the customer. KT AI does not send messages without customer authorization.

We are not responsible for customer non-compliance with Meta or WhatsApp policies. Violations may result in suspension or termination of Services without notice.

Data Processing & Privacy

KT AI processes data strictly on behalf of customers and in accordance with their instructions and our Privacy Policy.

We do not claim ownership of business data, message content, or customer information processed through the Services.

Accuracy & No Warranty

We do not warrant or guarantee the accuracy, completeness, performance, timeliness, or suitability of the Services for any specific purpose.

The Services may contain inaccuracies or errors, and we expressly disclaim liability for such inaccuracies to the fullest extent permitted by law.

Use at Your Own Risk

Your use of KT AI and its Services is entirely at your own risk. You are responsible for assessing whether the Services meet your business, legal, and operational requirements.

Third-Party Services & Links

The Services may include integrations with third-party platforms such as Meta, WhatsApp, cloud providers, or analytics tools.

KT AI is not responsible for the availability, content, performance, or policies of third-party services, which are governed by their respective terms.

Fees & Payments

Certain Services may require payment. Pricing, billing cycles, taxes, and payment terms will be communicated separately or governed by written commercial agreements.

Failure to pay applicable fees may result in suspension or termination of Services.

Refunds & Cancellations

Fees paid for KT AI Services are generally non-refundable unless explicitly stated otherwise in a written agreement.

Refunds, if any, are issued at our discretion based on service feasibility and contractual terms.

Force Majeure

Neither party shall be liable for failure or delay caused by events beyond reasonable control, including natural disasters, government actions, network outages, or third-party service failures.

Intellectual Property

All intellectual property related to KT AI, including software, branding, and documentation, is owned by or licensed to Kunisha Traders.

Termination

We reserve the right to suspend or terminate access to the Services for violations, misuse, or legal compliance requirements.

Limitation of Liability

To the maximum extent permitted by law, Kunisha Traders shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in Jaipur, Rajasthan shall have exclusive jurisdiction.

Changes to Terms

We may update these Terms periodically. Continued use of the Services constitutes acceptance of revised Terms.
